Managing Commercial Disputes Effectively:
An Australian and International Perspective
Donna Ross is a nationally accredited mediator, negotiator and arbitrator who holds common and civil law degrees, and has over twenty years of experience in international commercial contracts and disputes in Europe, the U.S. and Australia. Donna has worked with small and medium-sized companies as well as multinationals in many industries, with particular expertise in the wine industry, franchising and I.T.
She is a fellow of the Chartered Institute of Arbitrators, a professional member of Resolution Institute and a frequent speaker on mediation and arbitration.
Donna is the principal and founder of Donna Ross Dispute Resolution. The firm advises and works with businesses and professionals on commercial transactions, managing business relationships and dispute resolution as well as international law.
Disputes inevitably arise in business relationships. The key is to resolve them as efficiently as possible, preferably avoiding litigation.
Donna will describe the different means of ADR – Alternative Dispute Resolution, how they differ from litigation and the advantages and disadvantages of each one. She will also give an overview of the ADR landscape in Victoria, where courts are increasingly mandating parties to use mediation. Donna will also provide examples of appropriate clauses to use in international contracts that can assist parties, if not to prevent, at least to better manage disputes.
